Sealed Bids will be received by the City Finance Officer of the City of Valley Springs, South Dakota until 10:00 AM on Monday the 9th day of November, 2009 for the above referenced Project.
At or shortly after the time named above and within the City Hall, such Bids will be publicly opened, read aloud, and referred to the City Engineer for review. Bids will be passed upon by the City at a subsequent meeting of the City Council.

Brandon School District
The regular meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 26th of October, 2009 at the Valley Springs Elementary Music Building with the following members present: Jean Bender, Jay Rasmussen, Gregg Ode, Renee Ullom and Todd Egge. Absent: None. Also present were Superintendent David Pappone, Business Manager Paul J. Lundberg, High School Assistant Principal Brad Thorson, Middle School Principal Dan Pansch, Valley Springs Elementary Principal Bill Freking, Special Services Director Lyn Heidenson, and Operations Manager Todd Williams.
President Jean Bender called the regular meeting to order and opened with the Pledge of Allegiance.
Motion by Ode, seconded by Ullom to approve the agenda as presented. Motion carried.
Valley Springs Elementary Teacher Paula Gordon presented an elementary physical education college writing project. Based on a book study she participated in with her peers, Mrs. Gordon has been working with her students to become aware of college sports and especially college in general. They studied the NCAA tournament, the Olympics, and conferences and divisions in college sports. Gordon believes this project will be a constant reminder that college is important and definitely in our students’ futures.
Superintendent David Pappone updated the board on the absence report for the week of 10/19/2009, where absences have increased to 9.54% of our total student population. This rate has been slowly rising for 4 weeks and now has taken a sharp climb during the past two weeks of reporting. The current week shows signs for decrease in absences of students; staff illnesses continue to be manageable. Pappone also reported that School Improvement Plans have been submitted and available for the Board’s review on-line; these plans will be brought forward in the near future.
President Jean Bender discussed recent correspondence from parent Cameo Anders regarding Fred Assam Elementary school safety issues. The issue remains the concern of students walking along Six Mile Road. Ms. Anders recent correspondence has asked that the Board consider moving the crosswalk north to the Mystic Meadows Drive and construct a sidewalk to adjoin our property going north along the east side of Six Mile road to connect up to the crosswalk at Mystic Drive.
Superintendent Pappone has spoken to the adjacent homeowner of property involved in this construction and her only hesitation was snow removal. Pappone assured her that if the School District built the sidewalk, we would take on that obligation. She agreed, contingent upon the school maintaining the sidewalk. The Deputy State’s Attorney for Minnehaha County, Gordy Swanson, told Pappone that the county would approve our request for a sidewalk. The School District attorney did advise Pappone that as a School District, we have no legal obligation to build this sidewalk, however, if we do construct the sidewalk, we would have the same liability on that sidewalk that we have on the rest of our property’s sidewalks district-wide. Although Pappone believes this will set precedence, it is a unique situation that will not likely arise at any other school location.
Superintendent Pappone’s recommendation is to move the crosswalk north to the Mystic Meadows Drive and construct a sidewalk on the east side of Six Mile Road to provide a pathway to Fred Assam Elementary. Motion by Rasmussen, seconded by Ullom to provide a walk path on the east side of Six Mile Road (approximately 300 feet) from the current crosswalk to Mystic Drive, based on the following conditions:
1. Minnehaha County confirms this location is acceptable and this location maintains/increases current safety levels;
2. Landowner to the north approves the walk path where it crosses their property;
3. Minnehaha County and the city of Sioux Falls provides crosswalk flashers;
4. The sidewalk is built per the city of Sioux Falls specifications;
5. Ms. Cameo Anders recognizes in writing that the Brandon Valley School District has no obligation to provide walk paths to and throughout the Pine Lake Hills Development.
On a roll call vote, the following voted Aye: Rasmussen, Ullom, Egge, Ode, and Bender. Nay: none. Motion carried.
Motion by Egge, seconded by Rasmussen to appoint Renee Ullom as delegate to represent the Brandon Valley School District at the Associated School Boards of South Dakota delegate assembly. Motion carried.
Motion by Ullom, seconded by Ode to approve the following general business items:
1. Approve agreement with South Dakota State University concerning supervised Early Childhood Education student teaching program.
2. Approve addendum to Inter-Lakes Community Action Partnership Head Start Pre-Birth to Five contract.
Motion carried.
Motion by Rasmussen, seconded by Ullom to approve the following personnel items:
1. Resignation from Amy Forster, Brandon Elementary Special Education Educational Assistant, effective 10/22/2009.

3. Thank you from the Valley Springs Elementary staff for the opportunity to get the flu shots at work.

5. Thank you from Sandy Cummings and Merle Horst for providing the seasonal flu shots.
Board reports were heard. Alternative Education – Todd Egge reported on the East Dakota Educational Cooperative (EDEC) meeting that he attended on 10/21/2009.
Buildings and Grounds – Jay Rasmussen reported that the High School Art Room remodel will be on-going through November, 2009. Jean Bender thanked all those that came to the High School Classroom addition and Activity Center Open House/Ribbon Cutting last week.
Child Nutrition & Wellness – Jay Rasmussen reported they will be having a meeting on 10/28/2009.
Travel Reports were reviewed.

NOTICE TO BIDDERS
Sealed bids shall be received by the Corson Village Sanitary District, South Dakota, at the office of Stockwell Engineers Inc., 600 N Main Avenue, Suite 100, Sioux Falls, South Dakota 57104 until 10:00 A.M. on Friday November 20, 2009 and will be publicly opened and read.
This project involves the reconstruction of the entire water distribution system consisting of approximately 4,600 feet of PVC water main, 2,000 feet of water service line, bored water main, water meters, concrete surfacing, aggregate base course, seeding and all other related appurtenances.
The bidder shall submit the proposal on the form prescribed and proposals will be rejected if they show any conditions or uncalled for alternate bids. All bids shall be on the basis of cash payment according to the terms of the bid specifications.
A resident bidder is allowed a preference as against the bid of any bidder from any other state enforcing or having a preference for resident bidders, equal to such preference.
Each proposal must be accompanied by a certified check, cashier's check, or draft for five (5) percent of the amount of the bid, such check to be certified or issued by either a State or National bank domiciled within this State and payable to the Corson Village Sanitary District, South Dakota, or in lieu thereof, a bid bond for ten (10) percent of the amount of the bid, such bond to be issued by a surety authorized to do business in this state payable to the Corson Village Sanitary District, South Dakota. This sum is a guarantee that if the proposal is accepted, a contract will be entered into and its performance properly secured.
The Corson Village Sanitary District reserves the right to retain the bid security of the three lowest bidders for a period not to exceed 30 days after the date and time set for opening of the bids. The Corson Village Sanitary District reserves the right to reject any or all bids or any parts thereof.
The successful contractor and subcontractors on this project must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin.
Davis Bacon and Related Acts wages apply to this project. All provisions relative to those acts must be met.
Bidders on this work will be required to comply with the Presidents Executive Orders Nos. 11246 as amended, 11518, and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
Bidders on this work will be required to comply with Title 40 CFR 33.240 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows:
MBE – 1.0%
WBE – 3.0%
The low responsive bidder will be required to certify to compliance with the Buy American Iron, Steel, and Manufactured Goods provision of the American Recovery and Reinvestment Act of 2009. The certification form found on page BA-5 of the State Revolving Fund (SRF) General Conditions for American Recovery and Reinvestment Act of 2009 Projects must be included in the bid proposal.
Please be advised that waivers or exemptions from the Buy American provision that cite International Trade Agreements do not comply with the American Recovery and Reinvestment Act (ARRA) as it applies to the SRF programs. Claims from suppliers that the Buy American Iron, Steel, and Manufactured Goods provision does not apply to certain products based on the International Trade Agreement exemptions of the ARRA will not be accepted.
A pre-bid conference will be held on November 10, 2009 at 10:00 A.M. at Stockwell Engineer's Office.

PUBLIC COMMENT
Ron Klingenberg, county resident, commented on a recent action approving the purchase of weed control chemicals. He voiced concerns on chemicals in the ditches spreading to hay then to animals and eventually to crops/gardens through fertilization. He presented various documents detailing the use and safety precautions of various weed control chemicals. He asked that the Commission further research the issue and possibly notify the public of their use and hazards. Mr. Klingenberg responded to a question from Commissioner Barth on what alternative products are available. Mr. Klingenberg stated that he uses 2-4-D and ForeFront herbicide on his personal property. Ralph Hammer, Weed Supervisor, responded and explained that products are selected based on a study by SD State University and mowing restriction. Mr. Hammer and the Weed and Pest Board were asked to research this issue and give an update to the Commission at a later time.
BRIEFING
Janet Kittems-Lalley with the Compass Center and Amy Carter with Children's Inn presented a statistical report on domestic violence reports collected by the Minnehaha County Sheriff's Department, Sioux Falls Police, the Compass Center, and Children's Inn.

Sally Felix, Siouxland Libraries Director, reported that bids for the Crooks Branch Library renovation were opened on 10/21/09 at 2:00 p.m. The following bids were received: Beck & Hofer Construction, Inc. $102,876, BHI $128,700, Com-Res Inc. $104,635, Crown, Inc. $110,999, Eagle Design Build $124,425, Fiegen Construction $130,000, GA Johnson Construction $116,900, Golden Rule Construction $99,980, Husman Construction $107,600, Lloyd Construction $104,900, Peska Construction $98,500, Ron Anderson Construction $109,200, and Sunkota Construction $136,999. At the request of Bill Hoskins, Museum Director, MOTION by Kelly, seconded by Barth to authorize the Museum to hold 3 cash drawers in the amount of $150 each, for a total of $450, and to hold $1,000 in the checking account for credit card sales. 5 ayes. NUISANCE
On 9/15/09, the Commission entered into an agreement with Henry Dansman, county resident, allowing him until 10/25/09 to abate a public nuisance on his property, legally described as the W1/2 SW1/4 (Ex Trs 1 & 2 & Ex H-1, H-2, H-3) Section 29-T102N-R51W and the S1/2 SE1/4 Section 30-T102N-R51W, as a public nuisance. The property is located at 46106 261st Street, Hartford. Ryan Streff, Planner, reported that Planning and State's Attorney staff have been working with the owner on cleanup as detailed in the agreement. Much progress has been made and a list of remaining tasks compiled. Mr. Dansman's attorney, Cynthia Ahrendt, requested a deadline extension of 11 days because rain on several of the work days has slowed down the cleanup process. Mr. Streff reported that staff recommends a 22 day extension to ensure enough time is given to clean up the property without further delay. Commissioner Kelly asked the status of an additional lot owned by Mr. Dansman across the road. Ms. Ahrendt reported that some of the items were moved from the primary parcel to this location and can be cleaned up if necessary. MOTION by Kelly, seconded by Barth to extend the deadline to abate the Dansman public nuisance to 11/16/09 and authorize the Chairman to sign the extension. 5 ayes.
EM MGMT
MOTION by Hajek, seconded by Twedt to approve the following supplements from the Emergency Management Fund to the Emergency Management Budget: $3,917.23 (ASN 16927) 07 Citizen Corp Grant; $100,718.02 (ASN 16923) 08 Citizen Corp Grant and 08 Homeland Security Region 8 Grant; $73,589.72 (ASN 16992) 07 PSIC Grant; and $2,500 (ASN 16959) LifeLight support of Police Reserves. 5 ayes.
Lynn DeYoung, Emergency Management Director, requested approval of an agreement between Minnehaha and Lincoln County Emergency Management to develop a Pre-Disaster Mitigation Plan. The plan will identify potential threats to the community. South Eastern Council of Governments will provide professional services for the completion of the Plan which will be paid for through a FEMA Grant in the amount of $30,000 plus a $10,000 soft/cash match from the counties. MOTION by Hajek, seconded by Barth to approve the agreement. 5 ayes.
AGREEMENT
Sheriff Mike Milstead presented an agreement with the SD Public Assurance Alliance which offers a 5% police professional liability loss control credit, starting in 2010, for members who agree to adopt 12 law enforcement related policies. Sheriff Milstead reported that the policies are currently being reviewed and will be submitted for final approval before the 3/30/10 deadline. Sue Roust, Auditor, reported that the savings will be $5,000. MOTION by Hajek, seconded by Twedt to authorize the Chairman to sign the Law Enforcement Policies and Procedures Agreement with the SD Public Assurance Alliance. 5 ayes.
EQUALIZATION
On 10/20/09, Eli Whitney, Director of Equalization, briefed the Commission on a change in the method for assessing Ag land in the state from a market value approach to an agricultural income value (productivity method). The intent of the change is to provide the "true farmer" relief from the market based system. State law sets a minimum of 20 acres to receive the Ag classification, along with other conditions, and allows county commissions to increase the minimum acreage requirement up to 160 acres. Mr. Whitney believed an increase to a 40 acre minimum was more appropriate for Minnehaha County. Commissioner Hajek supported increasing the minimum size to 160 acres, noting that the true farmer is protected by the other requirements of the statute. Dick Kallemeyn, former Director of Equalization, supported the 40 acre minimum and explained how the minimum was set when legislation was first adopted. The intent was for Minnehaha County to start with the 20 acre minimum and raise it later. Commissioners were in consensus that full market value was most appropriate, but would work within the law. MOTION by Twedt, seconded by Barth to approve the recommended change in the minimum acreage size requirement from 20 to 40 acres for the Ag classification. 5 ayes.
NEW BUSINESS
Kari Benz, Assistant Human Services Director, briefed the Commission on a federal grant opportunity for the Project Safe Home Program through the SD Housing Development Authority on behalf of the Housing for the Homeless State Consortium. If funded, the Safe Home Program would be awarded $152,000 to be applied to building costs of a new structure. MOTION by Barth, seconded by Twedt to authorize the submission of an application for federal funding for Project Safe Home. 5 ayes.
