Sam Trebilcock, Sioux Falls Transportation Planner, gave a briefing on the Shape Sioux Falls 2035 Comprehensive Plan which was adopted by the city of Sioux Falls on 12/7/09. He discussed common issues included in Chapter 2 of the plan which includes the outlying joint zoning area. The joint boundaries did not change from the original plan because it is not anticipated that growth will exceed these boundaries. MOTION by Kelly, seconded by Pekas to approve Resolution MC10-09. 4 ayes. The City and Lincoln County concurred.

WHEREAS, the Joint City of Sioux Falls and Minnehaha County Planning Commissions have proposed a plan for the physical development of the joint jurisdictional area within the approved planning jurisdiction.
WHERAS, the Joint Minnehaha County and Sioux Falls Planning Commissions held a public hearing on January 25, 2010 to gain input from the public.
WHERAS, the Joint Sioux Falls City Council and Minnehaha County Commission held a public hearing on February 16, 2010 to gain input from the public.
WHERAS, The comprehensive plan, shows the Joint Sioux Falls and Minnehaha County Planning Commission's recommendations of guiding and accomplishing a coordinated, adjusted, and harmonious development of the joint planning jurisdictional area, which will, in accordance with existing and future needs, best promote health, safety, morals, order, convenience, prosperity or the general welfare, as well as efficiency and economy in the process of development.
NOW, THEREFORE, BE IT RESOLVED BY THE JOINT CITY OF SIOUX FALLS AND MINNEHAHA COUNTY GOVERNING BODIES, SD:
That the Shape Sioux Falls 2035 Comprehensive Plan is hereby adopted along with the accompanying maps and descriptive matter, for the Joint City of Sioux Falls and Minnehaha County planning area, with said plan to supersede the 2003 Sioux Falls Growth Management Plan. Said plan shall be on file in the office of the City Clerk, the City Planning Office, Minnehaha County Planning Office and city website and is available for public inspection by any interested person.

Notice is given that the City of Brandon, PO Box 95, Brandon SD 57005 has filed an application for a water permit to connect the Corson Village Sanitary District to the city’s municipal water system as required by ARSD 74:02:01:03.01. The City of Brandon holds Water Right Nos. 5507-3, 5868-3, 6156-3 (Split Rock Creek Aquifer) and 5869-3 (Big Sioux South Aquifer) for municipal use. WHEREAS, a petition of the owners of the adjacent property to that part of 1st Avenue North right of way in the Corson Development Park Addition to the City of Brandon, Minnehaha County, South Dakota, lying south of the south right of way line of East Willow Street has been filed with the Municipal Finance Officer, asking that the aforesaid be vacated. Pursuant to SDCL, notice of hearing has duly been given, and said notice was properly published; and
WHEREAS, the hearing held on February 16, 2010, and the petition has been duly examined and investigated by the City Council of the City of Brandon. Testimony in support of said petition has been heard, and no opposition thereto was voiced. Said property, as shown upon the plats attached to and made a part of said petition, has been used as a street or alley and no longer serves a useful public purpose.

Brandon Food Pantry Board of Director representatives were present to discuss the Food Pantry Building Lease Agreement. Alderman Hammond moved Alderman Jones seconded to adopt the agreement and authorize the Mayor or City Administrator to sign the necessary documents to complete the agreement. Motion carried
The Golf Course and Police Committee reports were heard. There was a discussion regarding parking on 8th Avenue. The proposal was to allow parking from Aspen Boulevard south on the west side of 8th Avenue to the first driveway. It was the general consensus of the Council to send this concern back to Planning & Zoning for an impact study of parking in that area.
The Park & Recreation and Administration Committee reports were heard. Contracts with Stockwells were discussed. Alderwoman Hansen moved Alderman Hammond seconded to approve the Mayor to sign the Bethany Meadows Drainage Basin Facilities Study contract and the Bethany Meadows Detention Pond construction plans contract. Motion carried.

WHEREAS, Brandon Ordinance 6-7-18 provides that the City may designate a Quality Assurance committee to perform duties specified therein; and
WHEREAS, the City desires to protect confidential patient medical information and to otherwise comply with requirements under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BRANDON, SOUTH DAKOTA, that the Quality Assurance committee shall be comprised of the City’s Administrator and Craig Jacobus, D.C., NREMT-P.

AN ORDINANCE OF THE CITY OF BRANDON, SOUTH DAKOTA PROVIDING THAT THE REVISED ZONING ORDINANCE NUMBER 206 AND THE OFFICIAL ZONING MAP OF THE CITY OF BRANDON SOUTH DAKOTA BE AMENDED TO PROVIDE FOR THE RE-ZONING OF THE FOLLOWING DESCRIBED PROPERTY.
WHEREAS the Brandon Planning and Zoning Commission held a public hearing on January 21 2010, as required by law, and made a “do pass” recommendation to the City Council to re-zone property described as Lot 2, Block 6, French Creek Addition at 928 Splitrock Boulevard from GB-General Business to R-2 - Multi Family.
WHEREAS the Brandon City Council held a public hearing on February 1, 2010 as provided by law and approved the re-zoning of the property by giving a first reading to this ordinance and a second reading of this ordinance on February 16, 2009.
THEREFORE, BE IT HEREBY ORDAINED BY THE CITY OF BRANDON, SOUTH DAKOTA: That the Zoning Ordinance of the City of Brandon, South Dakota, Ordinance Number 452, and the official zoning map of the City of Brandon, South Dakota be amended, to show a re-zoning of the following described proper from GB-General Business to R-2 - Multi Family.
Lot 2, Block 6, French Creek Addition.

NOTICE IS HEREBY GIVEN that the governing body, sitting as a Review Board of Equalization for the City of Brandon, Minnehaha County, South Dakota, will meet at 6:00 p.m. at the Brandon City Council Chambers at 308 Main Avenue, on Tuesday, March 16, 2010 for the purpose of reviewing and correcting the assessment of the City of Brandon for the year 2011.
