NO. 7181-3 to Appropriate Water
Notice is given that the City of Brandon, PO Box 95, Brandon SD 57005 has filed an application for a water permit to connect the Corson Village Sanitary District to the city’s municipal water system as required by ARSD 74:02:01:03.01. The City of Brandon holds Water Right Nos. 5507-3, 5868-3, 6156-3 (Split Rock Creek Aquifer) and 5869-3 (Big Sioux South Aquifer) for municipal use. This application requests authorization to connect the Corson Village Sanitary District to the city’s municipal system. No additional water appropriation is requested by this application.
Pursuant to SDCL 46-2A-2, the Chief Engineer recommends APPROVAL of Application No. 7181-3
because 1) existing rights will not be unlawfully impaired, 2) it is a beneficial use of water, and 3) it is in the public interest.
In accordance with SDCL 46-2A-23, the Chief Engineer will act on this application, as recommended, unless a petition is filed opposing the application or the applicant files a petition contesting the Chief Engineer's recommendation. If a petition opposing the application or contesting the recommendation is filed, then a hearing will be scheduled and the Water Management Board will consider this application. Notice of the hearing will be given to the applicant and any person filing a petition.
Any person interested in opposing or supporting this application or recommendation must file a written petition with BOTH the applicant and Chief Engineer. The applicant must file a petition if contesting the Chief Engineer's recommendation. The Chief Engineer's address is "Water Rights Program, Foss Building, 523 E Capitol, Pierre SD 57501 (605 773-3352)” and the applicant's mailing address is given above. Brandon Valley School District
The regular meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 22nd of February, 2010 at the Brandon Valley Middle School Media Center with the following members present: Jean Bender, Jay Rasmussen, Gregg Ode, Renee Ullom and Todd Egge. Absent: none. Also present were Superintendent David Pappone, Business Manager Paul J. Lundberg, Assistant High School Principal Brad Thorson, Middle School Principal Dan Pansch, Assistant Middle School Principal Randy Hill, and Valley Springs Elementary Principal Bill Freking.
President Jean Bender called the regular meeting to order and opened with the Pledge of Allegiance.
Motion by Rasmussen, seconded by Egge to approve the agenda as presented. Motion carried.
Brandon Valley Middle School Instructors, Nick Skibsted and Brady Olson presented a program they are teaching at the Middle School entitled “The Amazing Race”. This is a geography and math curriculum integration based on the reality show “The Amazing Race.” Skibsted and Olson based this project off of 21st Century skills and Project Based Learning, including collaboration, communication skills, respect, interpersonal skills, and lastly creativity. Technology and global awareness were also integral parts of this project.
Superintendent David Pappone reviewed a revised 5-year General Fund Projection sheet. The revision reflects the high probability of a 0% state aid increase for the next two years. Brandon Valley’s 2010-11 projected deficit is now estimated at $399,000.
Dwight Berglin, representing the accounting firm Quam & Berglin, CPA’s, presented the June 30, 2009 audit of the Brandon Valley School District 49-2. Motion by Ode, seconded by Ullom to accept the June 30, 2009 audit as presented. Motion carried.

A Real Estate Purchase Agreement between R.E. Lax Investments, LLC, and the Brandon Valley School District was reviewed. Motion by Rasmussen, seconded by Egge to approve the Real Estate Purchase Agreement to purchase approximately twenty (20) acres of real property located in the Northeast Quarter(NE¼) of Section 31, Township 101 North, Range 48 West of the 5th P.M., Minnehaha County, South Dakota for the purchase price of Five Hundred Forty Thousand Dollars ($540,000.00) which is computed based on Twenty-Seven Thousand Dollars ($27,000.00) per acre for twenty (20) acres. Motion carried.
Appointments were made to the area Equalization Boards. Meeting dates and times are yet to be determined:

Motion by Rasmussen, seconded by Ullom to approve the following general business items:
1. Recommendation to accept low bid of $68,513.00 from Guarantee Roofing & Sheet Metal (cost of $2.60/square foot) for the Brandon Elementary School Reroof project.
2. Approve administrative recommendation to deny open enrollment #11-29.
Motion carried.
Motion by Egge, seconded by Ode to approve the following personnel items:
1. Approve resignation/retirement of Marcia Petree, Robert Bennis Elementary 2nd Grade Teacher, effective at the end of the 2009-10 school year.
2. Approve request from Tracie Ode for leave without pay from March 9-15, 2010.
Motion carried.
Communications received by the Board of Education were reviewed. They included the following item:
1. Thank you from Gay Anderson and family for the plant sent in memory of her mother Verdyne E. Wacker.
2. Thank you from Heide and Matt Gedney for the plant sent for the birth of their daughter, Madeleine.
3. Thank you from Julie Reid for the plant sent in memory of her mother Verna L. Nielsen.
Board reports were heard. Alternative Education – At the last regular meeting, a slight decrease in enrollment and one decrease in staff was reported.
Buildings and Grounds – The next meeting for this committee is scheduled from March 2, 2010.
City Affairs & Legislation – Continue to watch what is happening in the current South Dakota Legislative session.
Child Nutrition & Wellness – The Brandon Valley Wellness Fair is scheduled for March 25, 2010 and this year two Wii gaming systems will be given away.
Travel Reports were reviewed.
Motion by Egge seconded by Rasmussen to go into Executive Session at 7:30 p.m. to discuss the Superintendent’s Evaluation.
The Board of Education came out of Executive Session and into Open Session at 8:30 p.m.

LIEN
Commissioner Pekas, County Aid Lien Liaison, briefed the Commission on a request to compromise DPNO 71555 in the amount of $658.61. The applicant is requesting a release of the lien with no payment. The applicant was the petitioner in an involuntary commitment. Pursuant to SDCL 34-20A-70.1, the county shall be reimbursed for attorney fees by the petitioner, if the petitioner is a family member and financially able to do so. The applicant claims that due to the economic downturn, it would be a financial burden to repay the lien. Commissioner Hajek noted the applicant's assets and explained that the petitioner is responsible for payment of the committal process and did not have to pay for the actual treatment. MOTION by Barth, seconded by Kelly to release DPNO 71555 in full with no payment. 2 ayes, Hajek and Pekas nay. Due to the tie vote, this item will be deferred until 3/2/10.
FINANCING
In 2008, the Commission authorized the issuance of 2009 tax-exempt revenue bonds in the amount of $9.8 million for a project at O'Gorman High School. The project involved two series of bonds. The Series A bonds were for a refinancing, and the Series B were for the construction of a new performing arts center and addition to the High School. The Bonds are to be repaid through pledges and donations over a period of time with prepayments to be applied equally between both series. Sherri Rotert, attorney for the Sioux Falls Catholic School Corporation (SFCS), reported that the SFCS would like to make a principal prepayment, but have been advised by their bond counsel that the payment would remove the tax exempt status of the Series A bonds. They are requesting approval of a waiver to waive compliance with the provisions of the bond documents by applying a disproportional payment to each series in order to keep the tax exempt status of the bonds. MOTON by Pekas, seconded by Barth to authorize the Chairman to sign the Waiver and Consent. 4 ayes.
BRIEFING
Chris Torkelson with Lloyd Companies briefed the Commission on the tax credit financing application for the Safe Home Project, prepared by the Minnehaha County Housing and Redevelopment Commission. The application deadline is 2/26/10, with notice on whether the application is approved or denied by early May. Commissioner Kelly reported that the HRDC met and elected officers and is awaiting a decision on the tax credits. Commissioner Barth noted the design change since the last concept. Sue Roust, Auditor, commented on the challenges in comparing the cost between conventional financing and the tax credit approach. She reported that a fair comparison indicates that conventional financing would cost about $75,000/yr more, but expressed concerns on additional obligations of future commissions for this project and discussed some of the requirements of the HRDC bylaws which could create additional expenses. Commissioner Kelly explained that there is the potential for additional positions with the HRDC, but this is not the intent for now. Hugh Grogan, Human Services Director, did not feel there were a lot of other options available due to the loss of other grant funding opportunities.
BIDS
Bob Meister, Highway Superintendent, reported on two bid lettings that were opened on 2/17/10.
Highway Project MC 50-146-130 was opened at 10:30 a.m. with the following bids received: Hollaway Construction Company, Inc. - $129,655.12; Nolz Dragline and Construction Inc. - $132,819.44; Graves Construction Company, Inc. - $170,995.02; and Swingen Construction Company - $175,174.80. He recommended award to the low bidder noting that the bid is $21,035 below the engineer's estimate. MOTION by Pekas, seconded by Barth to award Project MC 50-146-130 to Hollaway Construction Company, Inc. in the amount of $129,655.12. 4 ayes.
Highway Project MC 130BM-10 was opened at 10:45 a.m. with the following bids received: Myrl & Roy's Paving, Inc. - $1,118,507.49; Double H Paving, Inc. - $1,187,821.04; Asphalt Surfacing Co. - $1,206,429.87; and Sioux Falls Construction - $1,226,474.79. Mr. Meister recommended award to the low bidder noting that the bid is $44,265 above the engineer's estimate. MOTION by Pekas, seconded by Barth to award Project MC 130BM-10 to Myrl & Roy's Paving, Inc. in the amount of $1,118,507.49. 4 ayes.
The SD Department of Transportation conducted a bid letting for Project P-6364(06) on 2/17/10. They received 8 bids ranging from $872,680 to $739,637.90, $255,903.90 below their estimate. The project will be funded by the FHWA and SD DOT, and is subject to the concurrence of the County. MOTION by Barth, seconded by Pekas to concur with the SD DOT in the awarding of Project P-6364(06) to Myrl and Roy's Paving, Inc. in the amount of $739,637.90. 4 ayes.
AGREEMENTS
Kristin Trana, Sheriff's Office Administrative Coordinator, presented the 2010 Police Services Agreements for municipalities in Minnehaha County. The hourly rate for services increased 5% from $25.75 in 2009 to $27.00 per hour for 2010. The service hours for each community remained the same as in 2009. MOTION by Kelly, seconded by Barth to authorize the Chairman to sign the 2010 Agreement for Furnishing Police Service between Minnehaha County and the cities of Baltic, Colton, Crooks, Dell Rapids, Garretson, Hartford, Humboldt, and Valley Springs. 4 ayes.
UPDATE
Robert Wilson, Assistant Commission Administrative Officer, briefed the Commission on proposed legislation affecting county government.
