RESOLUTION #09-10
A RESOLUTION OF THE CITY OF BRANDON, SOUTH DAKOTA NAMING ALTERNATE REPRESENTATIVES FOR THE MAYOR TO REPRESENT THE CITY OF BRANDON ON THE SECOG EXECUTIVE BOARD.
WHEREAS, there are planning districts throughout the State of South Dakota to assist local governments; and
WHEREAS, the planning district in our region is located in Sioux Falls and is call the South Eastern Council of Governments, commonly referred to as SECOG; and
WHEREAS, per the Joint Cooperative Agreement of SECOG the Mayor of the City of Brandon has a seat on SECOG’s Executive Board; and

THE MINNEHAHA COUNTY COMMISSION CONVENED IN SPECIAL SESSION AT 5:00 P.M., February 25, 2010, pursuant to adjournment on February 23, 2010. Commissioners present were: Hajek, Barth, Kelly, and Pekas. Commissioner Twedt was absent. Also present were Sandy Kinder, Deputy Auditor, and Gordy Swanson, Chief Civil Deputy State's Attorney.
Chairman Hajek called the meeting to order.
AGREEMENT
Gordy Swanson, Deputy State's Attorney, reported that the tax credit financing application for the Safe Home Project is due on 2/26/10. He presented a lease agreement for the 3rd Street and Minnesota Avenue property with the Minnehaha County Housing and Redevelopment Commission. The lease provides a physical site for the application and will be for a 42 year term as per the requirements of the tax credit application. The lease specifies that the premises shall be used for the construction and upkeep of a facility to permanently house the homeless. Roger Mack with Lloyd Companies explained that if the tax credit application is approved, an LLC would be formed and the lease assigned to them with the approval of the Commission. He also recommended beginning the process of vacating the alleyway adjacent to the subject property. MOTION by Barth, seconded by Pekas to authorize the Chairman to sign the Lease Agreement with the Minnehaha County Housing and Redevelopment Commission.
MOTION by Pekas, seconded by Barth to adjourn until 9:00 a.m. on Tuesday, March 2, 2010. 4 ayes.

PLANNING
Pat Herman, Planner, gave the first reading of two proposed amendments to Ordinance MC16-90, 1990 Revised Zoning Ordinance for Minnehaha County. The first, Additional Use Regulations, adds vehicle restrictions for commercial, recreational, and agricultural vehicles and equipment. The second, Parking and Loading Regulations, adds definitions and text amendments to allow crushed asphalt as an option for hard surfacing. Each item will be heard separately. MOTION by Pekas, seconded by Barth to authorize the Auditor to publish Notice of Hearing on 3/16/10. 5 ayes.
Ms. Herman also gave the first reading of proposed amendments to Ordinance MC30-02, 2002 Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls. The proposed amendments are the same as those detailed above. MOTION by Pekas, seconded by Twedt to authorize the Auditor to publish Notice of Hearing on 3/15/10. 5 ayes.
LIEN
Pursuant to deferral on 2/23/10, the Commission again considered a request to compromise DPNO 71555 in the amount of $658.61. Commissioner Pekas, County Aid Lien Liaison, explained that the lien is for attorney services provided as part of an involuntary commitment and is filed against the petitioner (parent) pursuant to SDCL 34-20A-70.1. The applicant is requesting a release of the lien with no payment, claiming it would be a financial burden to repay the lien. It was noted that the applicant listed substantial assets on her petition for compromise of lien. Commissioner Barth felt that the law needed to be changed. MOTION by Barth, seconded by Twedt to release the lien in full with no payment. 2 ayes, Kelly, Pekas, and Hajek - nay. Motion fails.
AGREEMENT
Bob Meister, Highway Superintendent, presented the 2010 County Striping Program Agreement with the SD Department of Transportation. The agreement provides for pavement markings on 315 miles of Minnehaha County Highways at an estimated cost of $212,236.50. The County will be responsible for $147,475.08. MOTION by Pekas, seconded by Barth to authorize the Chairman to sign the Agreement to Provide for the Striping and Continuing Maintenance of County Roads Within Minnehaha County with the SD DOT. 5 ayes.
PROCLAMATION
Hugh O'Grogan, Human Services Director, read the 2010 St. Patrick's Day Proclamation of O'Minnehaha County. MOTION by O'Kelly, seconded by O'Twedt to approve the Proclamation. 5 ayes.
BRIEFING
Lynn DeYoung, Emergency Management Director, gave a briefing on the flood outlook for the area. He reported that several agencies have been and will continue monitoring activity in the area. Information on the spring flood outlook can be found on the National Weather Service Sioux Falls website. A link is available at www.minnehahacounty.org.
UPDATE
Robert Wilson, Assistant Commission Administrative Officer, briefed the Commission on proposed legislation affecting county government. He asked for direction on a request for county commissions to endorse SB 184, an act to revise certain provisions concerning the taxes imposed by water development districts and the formation of water development districts. The Commission was in consensus to remain neutral on this act.
OLD BUSINESS
Commissioners discussed the County Board of Equalization calendar.
Commissioner Barth announced that he would be absent for next week's meeting which includes the scheduled hearing to consider amendments to the Minnehaha County Drainage Ordinance. He explained that he strongly opposes the ordinance changes as constructed and requested that action on this issue be deferred, or that he be allowed to participate electronically. Commissioners noted that the time of the hearing has been published and that there have been many interested parties who would like to be present. Commissioner Twedt felt deferral should be a last resort and not done because of one commissioner's absence. Commissioner Kelly noted that the issue is not one that has to be solved next week. Commissioner Barth may participate by electronic means.
Commissioner Kelly commented on the placement of the screen at the podium as he is unable to see the information being presented on the screen. Commissioners discussed some of the update options being proposed for the meeting room.
NEW BUSINESS
Robert Wilson, Assistant Commission Administrative Officer, passed along a request from Ken McFarland, Commission Administrative Officer, who is in Pierre testifying on proposed legislation, asking if Mr. McFarland should testify on SB 130, an act to revise certain provisions concerning the township road system. Minnehaha County has opposed this legislation and the Commission concurred that Mr. McFarland should testify in opposition.
Commissioner Hajek announced that Commissioner Twedt will be meeting with members of the Multi-Cultural Center Board and will ask about a reduction in funding from the city of Sioux Falls as reported in the Argus Leader, and will bring that information back to the Commission.
Commissioner Hajek reported that the coroner committee met again last week and that they are moving forward on a plan that will work well for the County.
