PLANNING
Scott Anderson, Planning Director, was present for the first reading of proposed text amendments to the 1990 Revised Zoning Ordinance for Minnehaha County which would create a definition for Adaptive Reuse and make adaptive reuse a Conditional Use within the A-1 Agricultural District, RR Rural Residential District, R-1 Residential District, and RC Recreation/ Conservation District. Adaptive Reuse is the modification of an existing single family dwelling into an accessory building or use. MOTION by Pekas, seconded by Barth to authorize the County Auditor to publish Notice of Hearing on August 17th to consider the proposed amendments. 4 ayes.
LIEN
A request was received from lienee DPNO 64893 to compromise the $1,795.44 lien in full with no payment. The petitioner is presently unemployed, was recently released from the SD Penitentiary, and would like to clear up the lien account. MOTION by Barth, seconded by Pekas to deny the compromise request. 4 ayes.
HIGHWAY
Bob Meister, Highway Superintendent, was present to request that the County approve the award of a contract for improvements on MC County Hwy 130 to PCiRoads. The project will be funded 100% with federal and state funds. MOTION by Barth, seconded by Twedt, to approve Resolution MC10-33.
Resolution MC10-33
WHEREAS, the Minnehaha County Board of Commissioners wishes for the improvement of Minnehaha County Highway 130 Project #P-6364(05), and,
WHEREAS, the Minnehaha County Board of Commissioners has requested of the South Dakota Department of Transportation to, program and hold a bid letting, for the improvement of said highway, and,
WHEREAS, PCiRoads of St. Michael, MN was the low bidder with a bid of $593,169.91, for Project P-6364(05),
THEREFORE BE IT RESOLVED, that the Minnehaha County Board of Commissioners concur with the South Dakota Department of Transportation in the awarding of the low bid to PCiRoads of St. Michael, MN.

SAFE HOME
Pursuant to deferral on July 13, the Commission again considered a proposal to finance the Safe Home Project using Low Income Housing Tax Credits. Under this plan, Citibank would provide $2.26 million in funding toward the $3.47 million project cost. The County would contribute the building location at 3rd and Minnesota and $458,956 toward construction costs. The County would also set aside $300,000 in a reserve fund to cover shortfalls in operating revenues. Annual cost to the county is estimated at $394,000, as compared to $549,000 annually if the same building is financed using certificates of participation. Commissioners noted that the County will benefit from those annual savings for years to come. Craig Lloyd of Lloyd Co. spoke in support of the program and the use of tax credits. Mary Entinger, Executive Director of Citi Housing, commented on the benefits of tax credit financing. Commissioner Twedt thanked the Lloyd Companies and Chris Thorkelson, project coordinator, for their work. MOTION by Pekas, seconded by Twedt, to approve Resolution MC10-34 and authorize submission of the revised Project Safe Home Tax Credit Application to the SD Housing Development Authority. 4 ayes.

BE IT RESOLVED by the Minnehaha County Board of Commissioners that pursuant to action taken at the Board of County Commission Meeting on Tuesday, August 3, 2010, the board of commissioners hereby authorize the following actions:
• Minnehaha County authorizes the submission of the revised Tax Credit application to the South Dakota Housing Development Authority for Project Safe Home
• Minnehaha County will provide a loan commitment in the amount of $458,956 to the Minnehaha County Housing and Redevelopment Commission to be used towards construction costs for Project Safe Home at 6% interest for a period of 17 years
• Minnehaha County will place $300,000 at the end of the Project Safe Home Construction period in a committed fund within the General Fund to be accessed for operating expenses of the program in the event of a shortfall. All interest from the fund shall be deemed to be uncommitted funds within the County's General Fund and at the end of the tax credit program in 17 years, if not used, the original funds will be removed from committed status.
BE IT FURTHER RESOLVED, by the Minnehaha County Board of Commissioners that it is the intent of the County to continue to operate the program/facility for Project Safe Home for the entire affordability period.

WALL LAKE
Scott Anderson, Planning Director, presented a request from Girl Scouts Dakota Horizons to construct a 26'x30' shade structure at the Girl Scout camp in Wall Lake Park. GSDH has a lease agreement with the county which expires on 12/31/15. The agreement requires written approval by the County prior to any construction at the camp. Tami Haug-Davis, CEO of GSDH, was present in support of the request. MOTION by Pekas, seconded by Twedt, to approve construction of the structure as requested. 4 ayes.
OLD BUSINESS
Sue Roust, County Auditor, reviewed changes made to the Provisional Budget before its adoption last week, and suggested items which might be discussed at a further budget hearing before final adoption of the budget in September. Commissioner Barth stated his desire for a more detailed review of all department budgets. The Commission office will schedule a budget hearing for later in August.
Commissioner Twedt asked that the report from the County Treasurer and County Auditor on the impact of RV'ers on motor vehicle revenues and elections in Minnehaha County, which was requested in June, be scheduled for an upcoming Commission meeting.
NEW BUSINESS
Commissioners asked for clarification on whether the Emergency Operations Center was activated following last Friday's rain and flooding, and if so why they were not notified. It was also noted that Commissioners are not receiving notification of quarterly EOC meetings. Commission staff will follow up on these concerns.
MOTION by Barth, seconded by Pekas to adjourn into Executive Session for personnel discussion. 4 ayes. Following the Executive Session, the Commission adjourned until 9:00 a.m. on Tuesday, August 10, 2010.

The Minnehaha County Commission will meet in the County Administration Building at Sioux Falls, South Dakota on Tuesday, September 7th, 2010, at 9:15 A.M., for the purpose of considering the Provisional Budget for the year 2011 and the various items, schedules, amounts and appropriations set forth therein, and as many days thereafter as is deemed necessary until the final adoption of the budget on or before September 30th, 2010. At such time any interested person may appear either in person or by a representative, and will be given an opportunity for a full and complete discussion of all purposes, objectives, items, schedules, appropriations estimates, amounts and matters set forth and contained in the Provisional Budget.

Valley Springs
The Board of Commissioners for the City of Valley Springs, South Dakota met in Special Session on August 3rd at 7:00 pm at City Hall, 401 Broadway Ave.
The meeting was called to order by Mayor Scadden. Present: Mayor Scadden, Commissioners Hansen, Moss and Staeffler. Absent: Commissioner Helgeson.
Also present: Tim Hansen, Sandy Severtson, Patrick Glover (city attorney), West Acres Residents and Jeremy Scadden, Developer
A motion was made by Hansen, seconded by Moss to approve the agenda as stated. All voted yes. Motion carried.
The Utilities/Maintenance Sup’t explained the need to replace a portion of the culvert at Cliff Ave and Elm St. After discussing the matter, a motion was made by Staeffler, seconded by Moss to proceed with getting the culvert replaced with whoever could get it done the quickest. All voted yes. Motion carried. Jeremy agreed to look at the project.
Commissioner Moss facilitated the discussion on the West Acres Street Paving issue. Jeremy Scadden was asked if he had gotten estimates on paving the streets and if he had thought about what direction he wanted to go. He hadn’t gotten any estimates back and didn’t feel he could make a decision as what he wanted to do, until he knew the estimated cost of the project. After a lengthy discussion, the board agreed to schedule another special meeting for August 9th at 7 pm. Jeremy was directed by the attorney to have both the paving estimates and a plan regarding the financing by that meeting. Jeremy agreed to both. Jeremy asked for a copy of the Resolution of Necessity for Special Assessments, so he could review it.
A motion was made by Hansen, seconded by Staeffler to reschedule the regular August meeting from August 10th to August 17th at 6:45 pm at City Hall. All voted yes. Motion carried.

BRIEFING MEETING MINUTES
The Brandon City Council met in a briefing session at 5:30 p.m. on July 29, 2010 at the Council Chambers at 308 Main Avenue, Brandon, South Dakota. Present were Roger Brooks, Bob Bruning, Barb Fish and Dan Mostek. Others present were: City Administrator, Bryan H. Read; Finance Officer, Dennis E. Olson; City Engineer, Paul Sanow, Stockwell Engineers, Inc.; Police Chief, Dave Kull; Interim Public Works Director, Rollie Hoeke; and Director of Human Resources, Dan Oakland. Absent Mayor Larry Beesley, Mindy Hansen and Blaine Jones. Council Vice President Roger Brooks chaired the meeting.
The Council discussed the items on the agenda for the upcoming August 2, 2010 regular Council meeting. No formal action was taken.

At 6:00 p.m., a public hearing was held, as advertized, to consider a request for a One Day Wine License from the Brandon Edge for August 7, 2010 at McHardy Park for the Hometown Days Festival. Alderman Jones moved Alderwoman Fish seconded to approve the request. Motion carried.
The VFW also presented a request to waive the alcohol in public regulations for August 8, 2010, during the lawn mower races Sunday evening. Alderman Jones moved Alderwoman Hansen seconded to approve the request with the following conditions: that the area considered is the sidewalk adjacent to the VFW only; that portion of the sidewalk will need to be condoned off; and that the alcohol restrictions will be waived only during the event hours from 6:00 p.m. to 9:00 p.m. Motion carried.
Dana Clark informed the Council of a bicycle helmet donation to the City to be used by the Brandon Safety Committee to give out to the kids that participate in the Bike Rodeo at the Pigskin Classic. Thank you Dana.
The Golf Course, Police, Park & Recreation, Administration, and Street Committee reports were heard. Alderman Brooks moved Alderwoman Fish seconded to approve Resolution #21-10 for dedicating STIP funds for improvements to the intersection of Heritage Road and Holly Boulevard. A roll call vote showed Brooks, Bruning, Fish, Hansen, Jones and Mostek voting aye. Motion carried.
RESOLUTION #21-10
WHEREAS, the City of Brandon desires the construction and improvement of the road and/or bridge as hereinafter described:
LOCATION, LENGTH, STRUCTURE NUMBER:
Lane expansion of 1,00 feet will be centered on the intersection of Heritage Road and Holly Boulevard with 300’ tapers back to two lanes on the east and west ends of the project.
TYPE OF CONSTRUCTION:

To include grading, surfacing, pavement marking, signing, curb and gutter, additional turning lanes, storm sewer, sidewalks, street lighting and traffic signals.
MAJOR COLLECTOR ROUTE NUMBER:
1402
AND WHEREAS, the City of Brandon is obligated and hereby agrees to provide proper maintenance as required by the Federal Highway Act as amended and supplemented thereto for the project after construction is completed and to regulate or cause to be regulated the installation of utility facilities within the limits of the right-of-way of the proposed project in accordance with State and Federal requirements. AND WHEREAS, the City of Brandon is obligated and hereby agrees to reimburse the State for all costs not reimbursable with Surface Transportation Program (STP) Funds and associated State matching funds.
NOW THEREFORE BE IT RESOLVED: that the South Dakota Department of Transportation be and hereby is authorized and requested to program for construction, in accordance with the “Secondary Road Plan” and the State’s “Standard Specifications for Roads and Bridges,” the project described.
Estimated Cost of Project Including Engineering: $976,431.51
STP Funds: $600,000.00
Local Funds: $376,431.51
Proposed Year of Construction: 2012

The Water and Sewer Committee report was heard.
The preliminary 2011 budget was presented. The revenue portion was reviewed. No formal action was taken. There will be a special meeting at 6:30 p.m., on Tuesday, August 10, 2010 in the Council Chambers at 308 Main Avenue to further review the 2011 budget.
At 7: 02 p.m. on a motion by Alderman Jones seconded by Alderwoman Hansen the meeting was adjourned.
