The regular meeting of the Brandon Valley Board of Education, Brandon, SD was held at 6:30 p.m. on the 10th of June, 2013 at the Brandon Valley High School Community Room with the following members present: Jay Rasmussen, Renee Ullom, Sue Hegland, and Sandy Klatt. Absent: Gregg Ode. Also present were Superintendent David Pappone, Business Manager Paul J. Lundberg, High School Principal Gregg Talcott, Activities Director Randy Marso, Middle School Principal Dan Pansch, Fred Assam Elementary Principal Susan Foster, Special Services Director Lyn Heidenson, and Operations Manager Todd Williams.
Jay Rasmussen called the meeting to order and opened with the Pledge of Allegiance.
Motion by Klatt, seconded by Hegland to approve the agenda as presented. Motion carried.
Motion by Hegland, seconded by Klatt to approve the minutes of the regular meetings of May 13, 2013 and May 28, 2013 as presented. Motion carried.
Tami Jansma from the Valley Springs City Council presented results from the Safe Routes to School Grant that the City of Valley Springs applied for in April of 2013. Funds of a little over $11,000 have been awarded for the school to start a "100-mile club"; and $120,000 will be awarded to the city of Valley Springs for sidewalks, flashing yellow beacons, and push button activation on the yellow beacon lights. Funds will be available from this grant by October 1, 2013.
Motion by Klatt, seconded by Ullom to approve the bills and claims as submitted (see attached). Motion carried.
The cash report for the month of May, 2013 showed receipts of $5,805,895.08 and disbursements of $1,891,580.78, leaving a balance of $12,065,300.12. The General Fund had receipts of $3,130,027.11, and disbursements of $1,507,123.33, leaving a balance of $6,373,019.94. Capital Outlay Fund had receipts of $1,237,847.50 and disbursements of $93,889.34, leaving a balance of $2,685,670.45. Special Education Fund had receipts of $661,793.23 and disbursements $290,301.35, leaving a balance of $1,274,620.85. Pension Fund had receipts of $122,896.77 and disbursements of $0, leaving a balance of $769,727.82. Bond Redemption Fund had receipts of $652,625.47 and disbursements of $0, leaving a balance of $923,102.80. Enterprise Fund had receipts of $705.00 and disbursements of $266.76, leaving a balance of $39,258.26
The May, 2013 payroll totaled $1,262,559.85, of which $652,684.23 was instructional, $319,171.73 was support services, $26,796.25 was co-curricular, $203,867.54 was Special Education, and $60,040.10 was Food Service.
Motion by Hegland, seconded by Klatt to approve the financial reports as presented for the month of May 2013. Motion carried.
Administrative reports were heard. Superintendent David Pappone reminded board members of the Associated School Boards of South Dakota (ASBSD) Joint Convention being held at the Sioux Falls Convention Center on August 8-9, 2013. Early registration is available now. Pappone also provided an updated transportation report with readjusted categories for easier review.
Operations Manager Todd Williams reported that tonight is his last board meeting and he is now looking forward to retirement. After 27 years, Williams thanked the board for all that has been accomplished during that time.
A Facilities Review Committee has been meeting over the last few weeks. Co-chairpersons Mike Klumpp and Jean Bender presented the findings of this Facilities Review Committee.
Recommendations:
1. Construct a 5-6 intermediate school on the twenty acres of district-owned land just west of Robert Bennis Elementary that could be ready for occupancy in the 2015-16 school year.
2. Construct a secure entrance at BV Middle School, enlarge the commons, provide restrooms in commons and relocate a music room. Appendix C includes a drawing of the proposed changes. The provision of a secure entrance (all visitors and late-arriving students being required to enter through the office), while not the total solution to school security/student safety, is an important step. The Committee recommends this be completed as soon as funds are available.
3. Construct a secure entrance at BV High School by relocating the administrative/counselor offices to a new addition adjacent to the west side of the PAC. The space vacated by moving the offices would be recaptured as instructional space and would lengthen the time before another classroom addition is needed. The Committee recommends that a natural part of this office addition would be to include the scene shop and additional dressing rooms that were included in the original PAC plan but not built due to funding constraints. Appendix D includes a conceptual drawing of this space. The Committee recommends this be completed as soon as funds are available.
Note: The Committee also discussed the needs of the vocal music department at the high school and recommends the district continue to evaluate the appropriate time to build or remodel existing space.
4. The Committee supports the development of a comprehensive stadium renewal plan prior to any changes at the stadium to be sure that projects "fit" the plan without needing modification. The Committee recommends that the comprehensive plan be constructed in phases with the first phase of the stadium renewal being a new concession/restroom facility at the stadium. Other important aspects of the comprehensive stadium renewal plan (not in order of priority) are: a) lighting, b) track reconstruction, c) press box replacement, d) additional seating and e) artificial turf. The concession/restroom facility is recommended as funds are available.
5. Other needs related to maintenance shop space and small vehicle storage should be addressed as part of the Five Year Plan and should be continually evaluated by the Board.
6. The Board should continue to seek appropriate sites for future school buildings or the expansion of existing sites. The high school is landlocked and the site would be dramatically improved if additional space could be acquired.
Conclusion:
The immediate priorities for the district should include taking the steps necessary to construct the Intermediate School for occupancy in 2015-16. However, proceeding with the secure entrances at the Middle School and High School and planning for/beginning a phased project for stadium renewal are considered high priorities as well. The Committee did not discuss in depth how these projects would ultimately be funded but believes that a bond issue, combined with Capital Outlay Fund resources makes these projects viable for completion in the next two years.
A recommendation will follow at the next regular Board of Education meeting.
Motion by Ullom, seconded by Klatt to approve the following general business items:
1. Approve open enrollments as follows: #14-72, 14-73, 14-74, 14-75, and 14-76.
2. Approve Activity Pass Revenue Share proposal by and between the Brandon Valley School District and the Brandon Valley Athletic Booster Club.
3. Approve administrative recommendation for a vote for Dan Whalen, Pierre, T.F. Riggs High School, for SDHSAA 2013 Official Runoff Election Ballot for Division II representative, and a vote for James Hansen, Rapid City Area Schools, for SDHSAA 2013 Runoff Election Ballot for Large School Group Board of Education Position.
4. Approve awarding quote for Undyed E-10 and Undyed Diesel fuel to Harms Oil for a margin of -0.03 on all fuels for the 2013-14 school year.
5. Approve Brandon Valley School District participation in the South Dakota Retirement System Roth 457 plan.
6. Approve Child Nutrition Prime Vendor Contract between Food Services of America ("Prime Vender") and the Brandon Valley School District #49-2 (BVSD) for the 2013-14 school year.
7. Approve proposal to submit application for the South Dakota Department of Education Classroom Innovation Grant Program as presented by Andy Johnson and Brent Kramer. Motion carried.

1. Approve resignation submitted by Jeanette Hanson, BVHS Administrative Assistant, effective June 4, 2013.
2. Approve recommendation to hire Megan R. Sage, BE Special Education Teacher, BA+15 Step 5 ~ $35,915.00, effective for the 2013-14 school year.
3. Approve recommendation to hire Dan Murtha, BVMS Geography Teacher, BA Step 3 ~ $34,913.00, effective for the 2013-14 school year.
4. Approve recommendation to hire Morgan Bobzien, K-12 Instructional Technology Integrationalist, MA Step 8 ~ $37,498.00, plus 3 day extended contract ~ $621.00. Total contract of $38,119.00, effective for the 2013-14 school year.

3. Thank you from Lori Daniels for the support of the fund raiser after their recent house fire.
4. Thank you from Billie Taylor for the gold school bell in recognition of her retirement.
5. Thank you from Dan Pansch for the recognition of his years with the District and for his retirement at the banquet that was held on May 7th.

Notice is hereby given that sealed RFP's will be received at the George A. Gulson Administrative Center of the Brandon Valley School District #49-2, 300 South Splitrock Boulevard, Brandon, South Dakota, until 1:00 p.m. local time on the 1st day of July 2013, for the Dairy Vendor for the Brandon Valley, Harrisburg and Yankton School Districts, in accordance with specifications prepared by the Brandon Valley School District #49-2, 300 S. Splitrock Boulevard, Brandon, South Dakota 57005 to the attention of Gay Anderson, CNS Director.
Sealed proposals will be received at the office of the Child Nutrition Director, until 1:00 pm, July 1, 2013 local time. Proposals will be opened informally with Brandon Valley, Harrisburg and Yankton CNS Directors present on July 1st and reviewed at that time. RFP's received after said time will be returned unopened. Oral, telegraphic, or telephone proposal and modifications will not be considered. Proposals shall not be withdrawn by any bidder for a period of thirty (30) calendar days after opening of bids. Proposals submitted on forms other than the one provided will not be considered.
Each respective district Board of Education will review the RFP's received and pass upon them at a regular or special Board meeting to be held no later than thirty (30) days following the RFP opening.
The Board of Education of the Brandon Valley School District #49-2, Harrisburg School District 41-2 and Yankton School District 63-3, reserves the right to reject any and all proposals, to accept proposals it deems to be in its best interest, and to waive any or all informalities in bidding procedures.
By virtue of statutory authority, preference will be given to materials, products, and supplies found or produced within the State of South Dakota.

PLANNING & ZONING
COMMISSION
The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on May 16, 2013 at the Brandon City Council Chambers.
Roll call was taken. Members present were Chairman Chuck Parsons, Commissioners Paul Bosch, Tim Jorgenson, Bob Serk, Todd Stone, and Linda Weber. Also present were Alderman Roger Brooks, City Administrator Bryan Read and Mayor Larry Beesley. Absent was Building Inspector Dave Swier.
Commissioner Bosch moved Commissioner Stone seconded to approve the agenda. Motion carried.
Commissioner Stone moved Commissioner Serk seconded to move Item #1 on the Consent Calendar to a discussion item; and to approve the balance of the consent calendar which contained the following: a plat for Stone Ridge Addition Lots 1-8 Block 3, Lots 10-15 Block 4; a plat for Tallgrass Addition Lots 6-8 Block 5; a plat for Tallgrass Village Addition Lots 11B, 13B, 17B and 18B Block 1; and a plat for Paulson's Subdivision Lots 12A and 12B. Motion carried.
Commissioner Serk moved Commissioner Weber seconded to approve the minutes of the April 18, 2013 regular meeting. Motion carried.
Election of officers - Commissioner Serk moved Commissioner Weber seconded to leave officers as they stand - Chairman Chuck Parsons and Vice Chairman Paul Bosch. Motion carried.
A Home Occupation Application was presented for 805 S. 5th Avenue. Applicant Stacey Beckman was present. Wants to open a home daycare. Fence will be installed by June. Commissioner Weber moved Commissioner Bosch seconded to approve the application. Motion carried.
At 6:37p.m., Commissioner Stone moved Commissioner Serk seconded to continue the Planning & Zoning Commission meeting after the Board of Adjustment meeting. Motion carried.
At 6:37p.m. Chairman Parson called the Board of Adjustment meeting to order. Roll call was taken. Members present were Chairman Chuck Parsons, Commissioners Paul Bosch, Tim Jorgenson, Bob Serk, Todd Stone, and Linda Weber. Commissioner Stone moved Commissioner Jorgenson seconded to approve the agenda. Motion carried.
A public hearing was held, as advertised, for an appeal of a building permit that was issued for a home to be moved onto the property located at 1500 E. Birch Street (French Creek Addition Lot 9 Block 3) in the City of Brandon. Michael & Wendy Kessler, of 1409 E. Birch Street, filed the petition of appeal and were present. Wendy Kessler spoke that the home meets the manufactured home requirements/ definition as defined in City Ordinance, which she asserts would not be allowed in a R-1 zoned district. Property owners Cory Baker and Donal Gohman were present. Cory Baker spoke that the house is not a manufactured home, it used the normal stick built process; never had a hitch/chassis attached and will be placed on a foundation. Bob Serk asked for a certification from the State of Minnesota stating that the structure has been IRC approved based on construction. Kim Beiningan, of 809 N. Snowberry Circle, agrees that it should not be allowed, does not fit in the neighborhood. Della Kobernusz, of 1509 E. Birch Street, agrees that it should not be allowed, affecting the value of her home. Joe Brockmueller, of 908 N. Snowberry Avenue, is also opposed. Joe Brock, of 1405 E. Birch Street, is opposed, the home was previously used as an office building. Cory Baker said it was used as an office space and was also used as a model home.
In findings as such, the Board has considered the following: the property is zoned R-1 which permits single-family detached dwellings as per Brandon Ordinance 15-4; R-3 is the City of Brandon zoning district on which manufactured homes may be placed as per Brandon Ordinance 15-6; Brandon Ordinance 15-20-2 defines a manufactured home as "A dwelling unit which is fabricated in one or more sections at a location other than the home site by assembly line-type production techniques or by other construction methods unique to an off-site manufacturing process. A manufactured home is designed to be towed on its own chassis or be site delivered by alternative means. Every section shall bear a label certifying that it is built in compliance with the Federal Manufactured Home Construction and Safety Standards."; Brandon Ordinance 15-20-2 defines dwelling, single family detached as "A dwelling which is designed for and occupied by not more than one family and is surrounded by yards and is not attached to any other dwelling by any means."
The following evidence was demonstrated at the hearing: the unit was constructed in 2005 off site in one or more sections; the unit was transported to the site by Smooth Move of Irene, SD utilizing standard house moving techniques and equipment; the unit has never had its own chassis or hitch; the unit does not have a permanent steel sub structure for support; the unit will be affixed to a permanent foundation; there is no evidence that a manufacture's certificate of origin designated the unit as a mobile home; the unit is a modular home, which is required to comply with the City of Brandon's building (IBC) and not to the Federal Manufactured Home Construction and Safety Standards; there is no Federal Manufactured Home Construction and Safety Standards certification for the unit, nor can there be as it is a modular home. The dwelling unit does not meet the definition of a manufactured home under Brandon Ordinance 15-20-2 in that for this 2005 built unit the definition requires there to be a label and certification that the unit is built in compliance with the Federal Manufactured Home Construction and Safety Standards which there is and cannot be as this is a modular home not subject to these Standards. The owner shall provide documentation, from the State of Minnesota, of IBC certification or the City of Brandon will perform all customary inspections (at owners' expense) to ensure that the structure is in compliance with the IBC.
Commissioner Stone moved Commissioner Weber seconded to deny the appeal provided that the property owner provide documentation of IRC Certification by the State of Minnesota or be subject to normal building inspections by the City of Brandon. A roll call vote showed Parsons, Bosch, Jorgenson, Stone and Weber aye; Serk nay. Motion carried.
At 7:28p.m., have no further business for the Board of Adjustment, Commission Stone moved Commissioner Bosch seconded to adjourn the Board of Adjustment. Motion carried.
At 7:28p.m. Chairman Parsons continued the Planning & Zoning Commission meeting.
A preliminary plan was submitted for Sunrise Estates Phases 10-13. Tom Howey was present for discussion. Comments were received from Stockwell Engineers, Jon Brown was present. Concerns with no buffer between the GB-General Business and R-1 Single-Family zones. It was the consensus to make the proposed General Business zone R-2 Multi-Family. Another concern was the church property, that area would become land locked unless an access point is granted from the east or south. Commissioner Weber moved Chairman Parsons seconded to approve the preliminary plan contingent upon comments from Stockwell Engineers being met. Motion carried.
Comprehensive plan - process of updating. Toby Brown with SECOG was present for discussion. Next meeting to discuss will be June 20, 2013.
Building permits for April were presented #13-42 - #13-73. No action required.
Discussion on the plat for Little Ponderosa Lots 1-8 Block 1. Currently installing infrastructure, concrete channel being installed on the southeast corner. Commissioner Stone moved Commissioner Bosch seconded to approve the plat as signed. Motion carried.
At 8:07p.m. having no further business, Commissioner Stone move Commissioner Weber seconded to adjourn the Planning & Zoning Commission meeting. Motion carried.

Ryan presented two estimates for patching streets and crack sealing Southside Ave. After the discussion, a motion was made by Staeffler, seconded by Helgeson to accept the estimate from Seal Pros, Inc in the amount of $14,706.76 to patch streets and crack seal Southside Ave All voted yes. Motion carried.
A motion was made by Helgeson, seconded by Staeffler to renew the Employee's Health Insurance with Wellmark Blue Cross Blue Shield with the coverage being the same as last year. All voted yes. Motion carried. The rate increase was 12.93%.

The Letter of Appeal from the property owner of 305 Dunham was tabled until more information is gathered. A motion was made by Helgeson, seconded by Staeffler to authorize the Building Inspector to inspect the condition of the interior of the house before making a decision on the appeal request. All voted yes. Motion carried.
Extensive discussions have been held at the last few board meetings on the need to increase the water and sewer rates. The last rate increase was in 2002. Several different scenarios were discussed. The goal was to work toward getting the city in compliance with the State minimum requirements, which are necessary when applying for a grant/loan for infrastructure repair or replacement. This will also allow the city to have a reserve to put toward a project. After the discussion, a motion was made by Helgeson, seconded by Bauske to increase the minimum water rate to $36.75 per quarter for up to 6,000 gallons and over 6,000 gallons to $2.50 per thousand. The Sewer rate was increased to $60 per quarter. All voted yes. Motion carried. The rate increase will take effect starting the 3rd Quarter of 2013.
Commissioner Jansma gave an update on the Safe Routes to School Grant. The city received a grant in the amount of $120,216.75. This will allow the city to put in a new sidewalk from the school to Jackson Street, as well as new traffic signs along Valley Drive. The funds will be available this fall, with plans to do the project in the spring.
Ryan presented the Public Works Report. Several items were discussed including purchasing a generator and having Action Electric repair a light at the ball field.
A motion was made by Staeffler, seconded by Helgeson to adjourn. All voted yes. Motion carried.

The Valley Springs Planning and Zoning Board met on Thursday, June 6th, 2013 at 7:00 pm at City Hall, 401 Broadway Ave.
The meeting was called to order at 7:00 pm by Chairman Mike Langner.

Andy Schreiber was present to discuss plans for moving a house onto 416 Dunham Street (the empty lot south of Roger Vosburg's). After the discussion and upon the written recommendation of Dave Swier (Building Inspector), a motion was made by Brad, seconded by Allen to allow the house to be moved onto 416 Dunham Street with the owner being responsible for paying for the expenses of the water, sewer and lift pump (if needed), the route to bring the house into the city will be from the south off the gravel road by the cemetery and no surety Bond will be required. All voted yes. Motion carried.
Toby from SECOG was present to continue the process of updating the Comprehensive Plan for the city by discussing the future land use areas with the Board.
